Chapter 13 Bankruptcy
Chapter 13 provides provisions for bringing a mortgage or a car loan up to date. This can be an advantage when there are many assets that need to be protected from creditors. When the court becomes involved in debt liquidation, the assets are evaluated and may be sold to cover a portion of what is owed. It is important to discuss those assets that you need to protect early in the bankruptcy process so that the issue can be properly addressed before it is too late.
- Amount of debt discharged — Many people believe that there is a minimum amount of debt that is required before it is possible to declare bankruptcy. This is not true. The only thing that matters is whether or not you are able to make payments on the debts that you have.
- Medical bills and bankruptcy — Medical bills can build up quickly, particularly when you have a serious illness in the family without sufficient medical insurance to cover the cost. Discharging only your medical bills through a special "medical bankruptcy" is not an option. All unsecured debts, including medical bills are discharged at the same time through either Chapter 7 or Chapter 13.
